3.      There is new evidence of 8,257 cases of enforced disappearances, mass killings, fake encounters and illegal cremations in Punjab during the height of militancy and counter-insurgency period, a rights advocacy group claimed here on Sunday.
4.      In its report titled ‘Identifying the Unidentified’, the Punjab Documentation and Advocacy Project (PDAP) claimed to have collated details of “systematic killings by the Punjab police and security services” from 1980s to mid-1990s.
5.      “Our preliminary findings have shown that more than 95% of these reported encounter killings were fake…meaning that these were extra-judicial executions,” the PDAP said.
6.      The report claimed that 5,648 mass cremations of unclaimed and unidentified persons took place in Punjab during the period. It gave account of another 2,609 cases where identities of the victims are known.
7.      Senior advocate and rights activist Colin Gonsalves said not a single policeman went to jail or got life imprisonment for “killing in cold blood of people in custody”. “State terror is the deadliest of terror. There is no media coverage, no court cases, no documentation,” Mr. Gonsalves said, adding that the findings will be submitted to the Supreme Court.
8.      The report said “the perpetrators of these mass killings cremated the bodies of the victims as ‘ lawaris lasha ’ (unclaimed and unidentified) in an organised and systematic attempt to conceal and cover up their crimes”.
9.      “Unlike the process of identification of other mass killings, there were no bodies to exhume, there were no bones, there is no DNA profiling…but compelling evidence of crimes from witness testimonies which match exactingly and corroborate available official records,” the PDAP said.
Extensive probe:
10.  The finding is a result of extensive seven years of investigation process by the PDAP in which it went over records of cremation ground and crematoria from over 20 districts of Punjab.
11.  Satnam Singh Bains of the PDAP said in many cases the victims’ families were refused death certificates by the Punjab government. He said the government was under an obligation to disclose the name and identities of all persons missing and those killed by the police.
12.  Tapan Bose, secretary general of South Asia Forum for Human Rights and documentary film-maker, said: “When the State fails to protect the life of its own citizen, it becomes a constitutional failure”.
13.  The PDAP said a petition will be moved before the Supreme Court seeking the setting up of a high-level inquiry into the issue.

A Constitutional Commission should be set up!!!

1.        I am writing to you on my return to Delhi from the funeral   of SSP A.S. Sandhu.

2.       The real question is whether a strategy of State Terrorism was adopted by the police; and the answer is unequivocally in the negative.

3.        The police strategy (inhuman 'National Policy and Strategy') against terrorists gave the latter four options. The first three were conventional measures of response: the possibilities of arrest* (meaning: take into custody, capture, detain, catch, take in for questioning, pick up etc), flight** (meaning: trip, journey, voyage, passage, crossing, go in a boat, travel by water, air travel, put out to sea etc to abroad), or armed*** (Meaning: fortified, carrying weapon, equipped, prepared etc) engagement. The fourth option was offered in the later phases of the campaign. The terrorists were told that, if they chose surrender**** (meaning: lay down your arms, admit defeat, submit, yield, give in, give up etc), they would be welcomed and embraced with warmth. At first all surrenders took place in my presence and in some cases in the presence of the then Chief Minister. But after a while the deluge became difficult to handle, and SSPs were authorised to accept surrenders. The largest number of surrenders were before SSP A.S. Sandhu. And yet, he was a "blood thirsty man"!

CATEGORIES OF TERRORISTS AND THE OFFICERS IN ALL BRANCHES OF GOVERNMENT AND ADMINISTRATION INVOLVED IN THE INHUMAN ‘NATIONAL POLICY AND STRATEGY’ MUST BE IDENTIFIED BY A CONSTITUTIONAL COMMISSION FOR FACING JUSTICE

*Arrest meaning: take into custody, capture, detain, catch, take in for questioning, pick up etc

**Flight meaning: trip, journey, voyage, passage, crossing, go in a boat, travel by water, air travel, put out to sea etc to abroad

***Armed Meaning: fortified, carrying weapon, equipped, prepared

****Surrender meaning: lay down your arms, admit defeat, submit, yield, give in, give up etc

The Sikhs and others who were picked up spontaneously, unplanned manner surprisingly and later on killed, eliminated, liquidated, shown disappeared etc all including the given categories (the Punjab police not only used “cats but also rats, bats, camels and the ilk…..”) according to police are required to be identified by a 'Constitutional Commission' for facing justice and similar is the demand of former DGP K.P.S. GILL who clearly says that no government shall agree and allow to come out truth about the strategy of State Terrorism.

NOW HOW AND WHAT TO CONCLUDE THAT WHO IS WHO?
